Annual Returns

The Annual Return is a yearly submission to the Property Market Agency, required under Article 30 of the Property Market Agency Act (Chapter 644 of the Laws of Malta). It must be submitted by licence holders and partnerships, and it entails the declaration of the total number of transactions brokered (sales and rentals). In the Annual Return, licence holders and partnerships are to indicate the aggregate number and value of transactions brokered during the previous year.

Licence holders and partnerships who held a valid licence or authorisation at any time during the previous year are obliged to submit an Annual Return with the Property Market Agency.

The Real Estate Agent or Property Broker affiliated with the partnership is responsible for submitting the Annual Return on its behalf. In cases where more than one Real Estate Agent or Property Broker is affiliated, it is immaterial which individual submits the return.

The Annual Return for both license holders and partnerships is to be submitted no later than 31st July.

A transaction brokerage refers to instances in which the licence holder/partnership has collected a brokerage fee, typically following the signing of the property deed (Kuntratt) or rental/lease agreement.
